INFORMATION PURSUANT TO ART 13 OF LEGISLATIVE DECREE 196/2003
"Code regarding the protection of personal data"
Pursuant to article 13 of Legislative Decree 196/03 - Code regarding the protection of personal data - (hereinafter simply referred to for convenience as "Code"), the company Venice Arte SRL is required to provide some information regarding the use of personal data that concern you. The data held by our company are collected directly from the interested party, or from third parties, as in cases of acquisition from processing centers and archives, including public ones. To this end, an information note follows, containing the elements that qualify the processing carried out. The information already in our possession, or which may be acquired over time, will, in any case, be processed in full compliance with the aforementioned Code, including the confidentiality obligations set out therein.
1. PURPOSE AND METHODS OF DATA PROCESSING
The processing to which the personal data communicated or acquired will be subjected will be carried out as part of the execution of the activity of the Venice Arte SRL with the following purposes:
- Management of the existing contractual relationship, of the negotiations aimed at the conclusion of a contract and of the pre-contractual phase in general.
- Management of any contractual relationships that may be entertained in the future, including the management of disputes and credit protection activities.
- Fulfillment of legal obligations deriving from the existing relationship.
- Carrying out and developing institutional activities, involving, for example, statistical processing, marketing and advertising activities, including market research and promotional activities, commercial information and interactive commercial communications, in compliance with the legislation on business secrecy and industrial. The data will be processed for the entire duration of the contractual relationship and, even subsequently, for commercial purposes. The interested party may, at any time, request the deletion of his personal data from the archives, as indicated in point 5 below.
2. SCOPE OF COMMUNICATION
Without prejudice to the communications and dissemination carried out in compliance with legal and contractual obligations, the data may be communicated in Italy and abroad, in compliance with the purposes indicated above, to the following subjects:
Law firms, debt collection and credit insurance companies. Banks for business information. Factoring company. Credit institutions and other financial intermediaries for obligations related to the commercial relationship (for example for payments). Professionals, consultants and service companies. Parent, controlled and associated companies.
3. PROVISION OF DATA
The provision of the data necessary to fulfill the legal and fiscal obligations deriving from the existing commercial and contractual relationship is mandatory.
The provision of data not attributable to contractual or legal obligations is however optional.
4. REFUSAL TO PROVIDE DATA
The refusal to provide the data necessary to fulfill the legal and fiscal obligations deriving from the existing commercial and contractual relationship, or the subsequent denial of consent to their processing, will make it impossible for the undersigned , to proceed with existing commercial or contractual relationships. However, failure to provide all data that is not attributable to contractual or legal obligations will be assessed by the undersigned from time to time and will determine the consequent decisions related to the importance, for the Company, of the data requested and not provided.
5. RIGHTS OF THE INTERESTED PARTY
Regarding the data provided, the interested party can exercise the rights provided for by article 7 of the code and precisely:
Art. 7. Right of access to personal data and other rights
1. The interested party has the right to obtain confirmation of the existence or otherwise of personal data concerning him, even if not yet registered, and their communication in an intelligible form.
2. The interested party has the right to obtain: a) the origin of the personal data; b) the purposes and methods of processing; c) of the logic applied in case of processing carried out with the aid of electronic instruments; d) the identification details of the owner, managers and representative designated pursuant to article 5, paragraph 2; e) of the subjects or categories of subjects to whom the personal data may be communicated or who may become aware of them in their capacity as designated representatives in the territory of the State, managers or agents.
3. The interested party has the right to obtain: a) the updating, rectification or, when interested, integration of the data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including those whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data have been communicated or disseminated, except in the case in which this requirement is proves impossible or involves a manifestly disproportionate use of means compared to the protected right.
4. The interested party has the right to object, in whole or in part: a) for legitimate reasons to the processing of personal data concerning him, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning him for the purposes of sending advertising material or direct sales or for carrying out market research or commercial communication.
